Terms of Service

1. Acceptance of Terms

By creating an account, purchasing access, or using any part of the Pre-Cana Course platform ("Service") operated by PRECANACOURSE sp. z o.o. ("we", "us"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

Available markets. The Service is offered to consumers located in the United States and the United Kingdom. By accepting these Terms, you confirm that you are a resident of the United States or the United Kingdom at the time of purchase. We do not direct our offering to consumers residing in Poland, other EU/EEA member states, or any other jurisdiction. If you reside outside the United States and the United Kingdom, please refrain from purchasing — your local consumer protections may not be fully accommodated by the present documentation.

If you do not agree, you may not use the Service.

You confirm that you are at least 18 years old.

2. Definitions

  • "Service" — the Pre-Cana Course online platform, including videos, audio, scriptures, exercises, AI feedback, and certificates.
  • "Account" — the user profile created during registration.
  • "Content" — all course materials we provide (videos, text, audio, scriptures, exercise prompts).
  • "User Content" — any text, reflection answers, or data you submit through the Service.
  • "AI Feedback" — automated text responses generated by our integration with OpenAI's API.

3. License

Upon purchase or grant of access, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and view the Content for your personal, non-commercial use in preparation for marriage.

  • Access is single-user, lifetime for paid plans — one account per individual.
  • Your fiancé(e) may share access to a single household account, but credentials must not be shared outside that.
  • Sharing accounts, distributing Content, recording videos, or making derivative works is strictly prohibited.

4. Payment Terms

  • The course is sold as a one-time payment via Stripe or PayPal.
  • Pricing. The course is priced at USD $99 (one-time, payable by United States customers) or GBP £115 (one-time, payable by United Kingdom customers). The applicable currency is determined automatically based on the billing country selected at checkout.
  • Flat price. The amount displayed at checkout is the final amount you pay. We do not add any taxes, fees, or surcharges on top of the displayed price.
  • Payment is processed securely by Stripe (which also handles Apple Pay and Google Pay as payment methods routed through Stripe's checkout) or by PayPal; we do not store your card, bank, or wallet details. All payment credentials are handled directly by Stripe or PayPal on their PCI DSS Level 1 certified infrastructure.
  • Discount codes — one per order. Where we issue a discount code (for example through a parish or through a partner who recommended the course), a maximum of one code can be applied to an order. Codes cannot be combined or stacked. If you enter a second code, the first one is removed and you are told so on screen before you pay; the code left in place is the one you entered last. Where you reach us through a partner's referral link and have not entered any code yourself, that partner's discount is applied automatically — you can always remove it and enter a different code instead.
  • You authorize us to charge your selected payment method for the total amount.

5. Refund Policy

Two voluntary commercial guarantees cover the Service, both more generous than the statutory minimum:

  • a 30-day money-back guarantee from the date of purchase; and
  • a parish-acceptance guarantee — if your parish will not accept the course, we refund you in full. It has no deadline and does not require you to have completed any part of the course. The priest who marries you has the final say on which preparation programmes he accepts, which is exactly why we cover it.

Important — statutory right of withdrawal (digital content). The Service is a digital product made available to you immediately upon successful payment (see §12). Under Article 38(1)(13) of the Polish Act on Consumer Rights of 30 May 2014 (and corresponding provisions of EU Directive 2011/83/EU, as amended), a consumer loses the statutory 14-day right of withdrawal for digital content only where all four of the following are true: (a) performance begins with the consumer's prior express consent, (b) the consumer is informed before the start of performance that they will lose this right, (c) the consumer acknowledges that they thereby lose it, and (d) we have given the consumer a confirmation of the concluded contract on a durable medium recording that consent and acknowledgement (art. 15(1)–(2) or art. 21(1) of the same Act). Where any of the four is missing, the statutory right is not excluded and remains available to you.

Separately and regardless of that statutory position, we grant you the two guarantees above — protections more generous than the law requires, which neither replace nor reduce any statutory right you have.

6. Intellectual Property

6.1 Our Content

All Content (videos, scripts, audio, scripture commentary, exercise prompts, branding, design) is the property of PRECANACOURSE sp. z o.o. or licensed to us. Protected by copyright, trademark, and other laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or publicly perform any Content without our prior written consent.

6.2 Your Content

You retain full ownership of your User Content (reflection answers, exercise responses).

By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to process, store, and display it to you within your account, and to send it to our AI processor (OpenAI) solely for generating feedback for you. We will not use your User Content for any other purpose without your explicit consent.

7. User Conduct

You agree NOT to:

  • Share your account credentials with anyone outside your household.
  • Use the Service for any unlawful purpose.
  • Upload malicious code or attempt to reverse-engineer the Service.
  • Scrape, copy, or republish Content.
  • Harass, abuse, or impersonate other users or staff.
  • Submit User Content that infringes third-party rights or contains illegal material.
  • Bypass rate limits or attempt to manipulate AI feedback systems.

Violation may result in immediate account suspension without refund.

8. AI Limitations

AI Feedback is an automated text response generated by a large language model (OpenAI GPT-4o-mini).

  • AI Feedback is NOT professional pastoral counsel, marriage counseling, therapy, legal, medical, or financial advice.
  • AI Feedback may contain errors, misinterpretations, or theologically imprecise statements.
  • For matters of conscience, spiritual direction, or pastoral guidance, consult an ordained Catholic priest.
  • For mental health, marital, or relationship distress, consult a licensed professional.
  • For legal, medical, or financial decisions, consult a qualified professional in that field.

By using AI Feedback you acknowledge these limitations.

8a. Sensitive Data & AI Processing Consent (GDPR Art. 9)

The course is a Catholic pre-marriage preparation program. Your reflection answers, exercise responses, and other User Content may reveal "special category data" as defined by Article 9(1) of the GDPR and UK-GDPR, including but not limited to:

  • Your religious or philosophical beliefs (Catholic faith and practice).
  • Data concerning your relationship, sexual life, or intimacy.
  • Data concerning your mental or emotional state.
  • Data concerning health, family, financial, or personal circumstances.

By accepting these Terms of Service at registration, checkout, or first use of the Service, you give your explicit and informed consent under Article 9(2)(a) GDPR / UK-GDPR to the processing of this special category data for the following purposes only:

  • Providing the course content and tracking your progress.
  • Generating automated AI Feedback on your reflection answers via our processor OpenAI, Inc., as described in Privacy Policy §5.
  • Storing your reflections and feedback in your account so you can review them.
  • Generating your certificate of course completion.

This consent is specific, informed, unambiguous, and freely given. We bundle it into Terms acceptance — rather than collecting a separate checkbox — in order to reduce form friction; the substance of the consent (what is processed, by whom, on what basis, and how to withdraw) is fully and prominently described in this section and in our Privacy Policy, both of which you must read and accept before using the Service.

You can withdraw this consent at any time by closing your account via My Account → Data Privacy → Delete My Account. Withdrawal stops further processing of your reflection data but does not invalidate processing that lawfully took place before withdrawal. Note: if you withdraw, you will lose access to the AI Feedback feature and to your stored reflections.

If you do not consent to processing of special category data as described above, you must not register, purchase, or otherwise use the Service. Refunds for users who request deletion within the 14-day refund window are honored per §5.

Clergy verification: If you submit a clergy review-access request via our For Clergy form, we process your role-related disclosures under GDPR Art. 9(2)(e) ("data manifestly made public by the data subject") — clergy roles are typically public via diocesan registers — and solely for verifying your request. We do not require a separate consent checkbox for this form.

9. Disclaimers

THE SERVICE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

We do NOT warrant:

  • That the Service will be uninterrupted, error-free, or virus-free.
  • The accuracy, completeness, or reliability of any Content or AI Feedback.
  • That use of the Service will result in any specific marriage outcome.
  • That the Service meets the requirements of any specific diocese unless explicitly stated.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total liability for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
  • We are NOT liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
  • Nothing in these Terms excludes liability for fraud, gross negligence, or anything that cannot be excluded under applicable consumer protection law.

11. Termination

You may close your account at any time via My Account → Data Privacy → Delete My Account.

We may suspend or terminate your account immediately and without prior notice for material breach of these Terms.

Sections 6 (Intellectual Property), 9 (Disclaimers), 10 (Liability), 15 (Governing Law), and 16 (Disputes) survive termination.

12. Moment of Contract Conclusion

12.1 Two contracts

Use of the Service involves two distinct agreements with us:

  • Free service contract (the "Registration Agreement") — concluded the moment you create an Account by submitting the registration form, accepting these Terms, and confirming your email address (when required). Under this agreement we provide you with the basic, free elements of the Service (login, profile, optional free module, marketing communications you explicitly opt into).
  • Paid course contract (the "Sales Contract") — concluded the moment Stripe confirms successful authorization of your payment and we send you the order confirmation email containing your order number. At that exact moment, the Sales Contract is formed, course access is provisioned in your Account, and performance of the digital content begins for the purposes of §5 and Article 38(13) of the Polish Act on Consumer Rights.

12.2 Termination

Termination of either contract is governed by §11. Closing your Account terminates both contracts at the moment your deletion request is processed (after the 30-day soft-delete grace period described in our Privacy Policy). The Sales Contract is otherwise of indefinite duration insofar as you retain lifetime access to course content, subject to §3 (License) and §11 (Termination for breach).

13. Technical Requirements

To use the Service you need the following technical setup. We will provide the Service so long as you maintain these conditions; failure to meet them may prevent the Service from functioning properly and is not a defect of the Service.

13.1 Device and browser

A desktop, laptop, tablet, or smartphone with a modern web browser — the two most recent major versions of Google Chrome, Mozilla Firefox, Apple Safari, or Microsoft Edge. Older browsers may work but are not officially supported.

13.2 JavaScript and cookies

JavaScript must be enabled. First-party cookies are required for login, cart, and security. Disabling cookies prevents account access.

13.3 Internet connection

A broadband internet connection is required. We recommend at least 5 Mbps download for smooth HD video playback. Audio-only modules require less bandwidth.

13.4 Audio and video

A device capable of audio playback (speakers, headphones, or built-in audio). Video lessons require a screen capable of playing HTML5 video and are best viewed at 720p or higher.

13.5 Account requirements

A valid email address you can access (used for login, order confirmations, and password reset). You must be at least 18 years old (§1).

13.6 Email deliverability

Transactional emails (order confirmations, password resets, course updates) are sent from our domain. To receive them reliably, please ensure our address is allow-listed in your email provider and check your spam folder if a message does not arrive.

14. Complaints Procedure

Pursuant to Article 8(3)(4) of the Polish Act on Provision of Services by Electronic Means of 18 July 2002, you may file a complaint regarding the Service. This procedure is distinct from the refund request procedure described in §5 and on our Refund Policy page — a complaint addresses defects, errors, or improper performance, while a refund request seeks reimbursement under our voluntary 30-day money-back guarantee.

14.1 Scope

You may file a complaint regarding, in particular:

  • technical defects of the Service (login failures, broken playback, missing content, errors in saved progress),
  • billing or payment errors (incorrect amount charged, duplicate charge, invoice issues),
  • quality issues with course content (factual inaccuracies, broken links, missing files),
  • AI Feedback malfunctions (note: AI Feedback by its nature may produce imprecise responses — see §8; only technical malfunctions are within scope),
  • any other failure of the Service to perform substantially as described.

14.2 How to file

Send an email to [email protected] with the subject line "Complaint" and include:

  • your full name and the email address used for your Account,
  • your order number, if the complaint relates to a paid order,
  • a clear description of the issue, the date it occurred, and what outcome you expect (e.g., correction, redelivery, refund),
  • any supporting evidence (screenshots, error messages, browser/device used).

14.3 Acknowledgement and response

We will acknowledge receipt of your complaint without undue delay. We will provide a substantive response within 14 days of receipt, in accordance with Article 8(3)(4) of the Polish Act on Provision of Services by Electronic Means and Article 7a of the Polish Act on Consumer Rights. If we cannot resolve the matter within 14 days, our response will explain the reason for the delay and indicate when you can expect a final decision.

14.4 Outcomes

If your complaint is accepted, we will at our reasonable discretion correct the defect, redeliver the affected content, extend your access where appropriate, or, where the complaint relates to a paid order and no remedy is feasible, issue a partial or full refund. If your complaint is rejected in whole or in part, our response will explain the reason.

14.5 Out-of-court resolution

Nothing in this section limits your right to pursue claims in the competent court (§16) or, for EU consumers, to use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. US consumers may additionally pursue chargeback procedures with their card issuer, although we ask you to contact us first so we can resolve the matter directly.

15. Governing Law

These Terms are governed by the laws of Poland, without regard to its conflict of laws principles.

Nothing in these Terms limits or excludes any consumer protections mandatorily applicable under the law of the consumer's place of habitual residence. In particular:

  • Consumers located in the European Union or the EEA retain the mandatory consumer protection rights of their country of habitual residence (including any applicable rights under Directive 2011/83/EU or equivalent national legislation), to the extent such rights cannot lawfully be derogated from by agreement.
  • Consumers located in the United Kingdom retain the mandatory consumer protection rights afforded by United Kingdom law, including (without limitation) the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These rights apply in addition to the protections offered under Polish governing law, and where the mandatory provisions of UK consumer law are more favourable to the consumer they prevail. For the avoidance of doubt, UK customers pay the GBP £115 flat price described in §4 and benefit from the 30-day money-back guarantee described in §5 (and in our Refund Policy) in full.
  • Consumers located in the United States retain the protections of applicable federal and state consumer protection laws, including (without limitation) the California Consumer Privacy Act (CCPA/CPRA) and analogous state privacy statutes, state automatic renewal laws, the FTC Restore Online Shoppers' Confidence Act (ROSCA) to the extent applicable, and any algorithmic pricing, disclosure, or unfair-and-deceptive-practices obligations applicable in the consumer's state of residence.

16. Dispute Resolution

Before filing any claim, you agree to first contact us at [email protected] and attempt to resolve the dispute in good faith for at least 30 days.

Any unresolved dispute will be submitted to the exclusive jurisdiction of the courts competent for the registered seat of the Company in Wrocław, Poland, unless mandatory law in the consumer's country of residence requires otherwise.

EU consumers may also use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

17. Updates to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
