1. Parties and Scope

These Affiliate Program Terms ("Program Terms") govern your participation in the Pre-Cana Course affiliate program operated by KM VENTURES Spółka z ograniczoną odpowiedzialnością (operating as KM VENTURES sp. z o.o., formerly PRECANACOURSE sp. z o.o.; "we", "us", "our"), registered at ul. Oleśnicka 16/1, 50-320 Wrocław, Poland · NIP 8982334303 · KRS 0001243785 · REGON 544857191.

They apply to you ("you", "Partner") from the moment we enable the affiliate program on your account. They are in addition to, and do not replace, our Terms of Service and Privacy Policy, which continue to apply to your use of the platform. Where these Program Terms conflict with the Terms of Service on a matter specific to the affiliate program, these Program Terms prevail.

These Program Terms do not affect the rights of the people you refer. Their purchase is governed entirely by our Terms of Service and Refund Policy, exactly as if they had arrived without a referral.

2. Definitions

  • "Referral Link" — a link to our website containing your unique referral code, for example https://precanacourse.com/?ref=YOURCODE.
  • "Referral Code" — the unique code assigned to you. It doubles as a discount code that your audience can type at checkout.
  • "Referred Customer" — a person whose purchase is attributed to you under §5.
  • "Qualifying Sale" — a completed, paid purchase of the course attributed to you, which has not been refunded, charged back, or voided under §8.
  • "Net Revenue" — the amount the Referred Customer actually paid for the course, excluding any tax, minus the fee charged to us by the payment processor (Stripe or PayPal) for that transaction. Defined precisely in §7.
  • "Commission" — your share of Net Revenue, as set out in §7.
  • "Partner Panel" — the affiliate area of your account, where your link, statistics, and payout details live.

3. Who Can Join

The program is invitation-only. There is no public sign-up form. We enable it manually on individual accounts — typically clergy, marriage-preparation coordinators, parish staff, writers in the Catholic space, and graduates of the course who want to recommend it.

To take part you must:

  • be at least 18 years old and have the legal capacity to enter into this agreement;
  • hold a valid account on our platform, registered to an e-mail address that reaches you;
  • accept these Program Terms in the Partner Panel; and
  • provide accurate payout and tax-residency information before any payment can be made to you (§10, §11).

We may decline to admit anyone to the program, and we are not obliged to give a reason. Admission is personal to you and cannot be transferred, sold, or assigned to anyone else.

4. How the Program Works

  1. We give you a Referral Link and a Referral Code.
  2. You share them with people who might benefit from the course.
  3. Someone who follows your link gets your 10% discount applied automatically at checkout. Someone who types your Referral Code manually gets the same discount.
  4. When they buy, we record the sale against your account and open a Commission entry.
  5. After the 30-day holding period in §9 the entry is approved, and it is paid out in the next monthly payout run (§10).

The 10% discount is a benefit for the person you refer. It is funded by us, not deducted from your Commission — but because Commission is calculated on Net Revenue, the discount does reduce the base your Commission is calculated from. §7 shows exactly how.

5. Attribution Window and Conflicts

When somebody visits our site through your Referral Link, we store a small file in their browser (a cookie named precana_ref) for 90 days. If they buy within that window, the sale is attributed to you — even if they leave and come back later.

If more than one referral signal is present on the same order, we apply them in this order of priority:

  1. a Referral Code entered manually at checkout (a deliberate choice by the buyer beats any stored cookie);
  2. the 90-day referral cookie;
  3. a permanent link recorded on the buyer's account, created when they registered or logged in while your cookie was active;
  4. the referral held in the current shopping session.

An important limitation you should know about. The referral cookie is a marketing cookie under EU and UK law, so it is only stored if the visitor accepts marketing cookies on our consent banner. If a visitor refuses, we can normally only attribute the purchase within the same browsing session, and attribution may be lost if they return days later. Your discount still applies to them either way — the person you referred is never worse off. We do not, and legally may not, work around this. It is a real limit on how much of your traffic can be tracked, and we would rather you knew it up front than discovered it in a statement.

We also cannot attribute a sale when the buyer's browser blocks cookies, when they buy on a different device without logging into an account linked to you, or when more than 90 days pass between the click and the purchase.

6. One Discount Code Per Order

Our store accepts a maximum of one discount code per order. This applies across the whole shop, including parish discount codes and any future promotion — codes cannot be combined or stacked.

In practice this means:

  • If the buyer's basket is empty of codes when they arrive through your link, your 10% code is applied automatically.
  • If they have already entered another code (for example a parish code), we do not remove it or replace it. Their existing discount stands, and the sale may be attributed to a different partner or to none.
  • If they then enter a second code themselves, the first one is removed and they are told so explicitly on screen. The code left in place is the one they entered last.

Commission follows the code that is actually used on the order, together with the attribution rules in §5. Where a parish code was used, no affiliate Commission arises on that order.

7. Commission and How It Is Calculated

Your Commission is 20% of Net Revenue on each Qualifying Sale.

Net Revenue means: the amount the Referred Customer actually paid for the course, excluding any tax, minus the fee our payment processor charged us on that transaction. So the discount you gave your audience, and the card-processing fee we were charged, are both taken off before your 20% is calculated.

Your Commission is therefore not a fixed amount per sale. It varies with the currency, the payment method, the card type, and any discount applied. The worked examples below are illustrative, not a guarantee.

7.1 Worked example — a US sale at the list price

Course list price$99.00
Your 10% referral discount− $9.90
Amount the customer pays$89.10
Payment processing fee charged to us (approx. 2.9% + $0.30)− $2.88
Net Revenue (your commission base)$86.22
Your Commission (20% of Net Revenue)$17.24

7.2 Worked example — a UK sale at the list price

Course list price£115.00
Your 10% referral discount− £11.50
Amount the customer pays£103.50
Payment processing fee charged to us (approx. 1.5% + £0.20 for UK cards)− £1.75
Net Revenue (your commission base)£101.75
Your Commission (20% of Net Revenue)£20.35

7.3 Currency

Commission is calculated and recorded in the currency of the order — US dollars for a US sale, pounds sterling for a UK sale. We keep a separate balance per currency and we do not convert between them. If you earn in both currencies, you may receive separate payments. Where your bank or payment provider converts a payment into another currency, the exchange rate and any conversion charge are theirs, not ours.

7.4 When the processing fee is not yet known

Payment processors report their exact fee to us shortly after the transaction, sometimes with a delay of hours. Where the exact fee is not yet available, we open the Commission entry using a good-faith estimate and recalculate it against the actual fee when the entry is approved at the end of the holding period (§9). Once approved, the amount is fixed and will not be revised downwards afterwards.

In the rare case where the processor settles a transaction in a currency other than the order currency, we use the estimated percentage rather than converting, so that you are never charged an exchange loss that we did not actually incur on your sale.

7.5 Rate changes

We may change the commission rate or the discount percentage for future sales. The rate in force at the moment of a sale is recorded on that Commission entry and is never changed retroactively. We will notify you by e-mail at least 30 days before a reduction in the commission rate takes effect.

8. When No Commission Is Earned

No Commission arises where:

  • You buy the course yourself. Purchases made by you, or from your account's e-mail address, do not earn Commission. You may of course use your own discount — you simply do not earn on your own purchase.
  • The order was placed using a different discount code (§6).
  • The order is refunded, cancelled, or charged back (§9).
  • The sale results from activity prohibited under §12, or from any attempt to manufacture sales artificially.
  • The amount actually received after the discount and processing fee is zero or negative.
  • The affiliate program was disabled on your account at the time of the sale.

Voided entries remain visible in your Partner Panel with the reason shown, rather than silently disappearing.

9. Holding Period, Refunds, and Clawbacks

Every Commission is held as pending for 30 days from the date of the order. This mirrors the 30-day money-back guarantee we give every customer — we cannot pay out a commission on a sale that may still be returned.

After 30 days, provided the order is still valid, the Commission is approved and becomes payable in the next payout run.

If an order is refunded or charged back:

  • before the Commission has been paid to you, the entry is reversed and no payment is made;
  • after it has been paid to you, we record a corresponding negative entry ("clawback") which is offset against your next payout. We do not edit past records or ask you to send money back — the balance simply carries.

Where a refund is partial, the clawback is proportionate.

If you leave the program, or we close your participation, Commissions already approved remain payable to you under §10, subject to the same clawback rules. Pending Commissions continue to mature normally unless the closure was due to a breach of §12.

10. Payouts

We prepare payouts on the 1st day of each month, covering all Commissions approved by that date. Payments are made manually after we prepare the run, normally within 10 business days.

10.1 Methods and thresholds

Method Minimum balance Transfer cost
Revolut None — paid from the first cent None
PayPal None — paid from the first cent None deducted by us
Bank transfer $200 / £200 Borne by you — see §10.2

We recommend Revolut or PayPal. They have no minimum and nothing is deducted, so you receive the full amount you earned.

10.2 The cost of an international bank transfer

If you choose to be paid by bank transfer, the cost of the international transfer is yours, not ours. We deduct a fixed amount from the payment to cover it — currently $25 or £20 — and show the deduction on your payout statement as a separate line, so you always see the gross Commission, the deduction, and the amount actually sent.

We use a fixed, published deduction rather than passing on the bank's variable charge, so that you can predict the figure. Where your bank or an intermediary bank applies further charges of its own on receipt, those are outside our control and are not reimbursed by us. This is why we recommend Revolut or PayPal, where none of this applies.

10.3 Balances below the threshold

If your balance is below the minimum for your chosen method, nothing is lost — the balance carries over to the following month and is paid as soon as it reaches the threshold. You can switch to Revolut or PayPal at any time in the Partner Panel to be paid without a minimum.

10.4 Conditions of payment

We can only pay you once you have provided complete, accurate payout details and the tax information required under §11. If a payment fails or is returned because the details you gave were wrong, we will contact you, and any charge we incur as a result of the incorrect details may be deducted from the reissued payment.

Commission balances do not accrue interest. If your account becomes unreachable and a balance stays unclaimed, we will make reasonable attempts to contact you at the e-mail address on your account before treating the balance as dormant.

11. Taxes and Your Status

You are responsible for your own taxes. Commission is gross income to you. We do not withhold, calculate, report, or advise on income tax, self-employment tax, VAT, GST, or social contributions arising in your country of residence, and nothing in these Program Terms is tax advice. If you are unsure how commission income should be treated where you live, please speak to your own accountant before joining.

Because we are a Polish company paying commissions across borders, we may be required to collect certain information or documents from you before a payment can be made, in particular:

  • your country of tax residence;
  • whether you are acting as a private individual or through a business, and, if a business, your business registration or tax identification number;
  • an invoice from you, where your status requires that commissions be invoiced; and
  • a certificate of tax residence issued by your tax authority, where one is needed to apply a double-taxation treaty.

Where Polish law requires us to withhold tax at source on a payment to you, and no exemption or treaty relief is available to us on the documents you have provided, we will withhold the amount required by law and give you the corresponding statement. We will tell you before this happens rather than after, and we will always accept correctly issued documentation that removes or reduces the withholding.

You confirm that the tax residence you give us is accurate, and you agree to tell us if it changes.

12. How You May and May Not Promote

We built this program for people who genuinely believe the course helps couples prepare for marriage. Recommend it the way you would recommend it to a friend. Concretely:

12.1 You may

  • share your Referral Link in homilies, parish bulletins, newsletters, talks, social posts, videos, and personal messages;
  • write your own honest review or description of the course;
  • quote our published descriptions, prices, and module titles accurately;
  • use our name and logo to identify the course you are recommending, unaltered and without implying that you speak for us.

12.2 You may not

  • Send unsolicited bulk messages. No spam by e-mail, SMS, messaging apps, comment sections, or forums. Only mail lists that consented to hear from you.
  • Bid on our brand. No paid search or social advertising on "Pre-Cana Course", "PRECANACOURSE", our domain name, or close variants and misspellings of them. You may advertise on generic topical terms.
  • Impersonate us. No websites, social accounts, e-mail addresses, or domains that could be mistaken for ours; no claiming to be our employee, agent, or an official representative; no sending messages that appear to come from us.
  • Make claims about outcomes. Do not promise that the course will save, improve, or guarantee anything about anyone's marriage or relationship, and do not present it as therapy, counselling, canonical instruction, or a substitute for a diocesan requirement.
  • Claim endorsement we do not have. Do not describe the course as approved, endorsed, mandated, or required by any diocese, bishop, parish, or Church authority.
  • Misstate the offer. No invented prices, expiry dates, scarcity, bonuses, or discounts other than the 10% we actually provide.
  • Post the code to discount and coupon aggregators without our prior written agreement. Your code is meant for your own audience.
  • Manufacture sales. No self-referrals through other accounts or addresses, no cookie stuffing, no automated clicks, no purchases made with the intention of being refunded, no incentivising people to buy and refund.
  • Interfere technically. No browser extensions, redirects, iframes, pop-unders, or scripts that inject your code into another visitor's session.

If you are unsure whether something is allowed, ask us first. We would much rather answer a question than withhold a commission.

13. Mandatory Disclosure of the Relationship

Whenever you recommend the course to an audience, you must make clear that you may earn a commission. This is a legal requirement in several of the places our customers live, and it is also simply honest.

  • United States — the Federal Trade Commission requires a clear and conspicuous disclosure of any material connection between an endorser and a seller (16 CFR Part 255). Place it where the recommendation is, not behind a link, and not only at the bottom of a page.
  • United Kingdom — the CAP Code and the Consumer Protection from Unfair Trading Regulations require advertising to be obviously identifiable as such. On social media, label it clearly, for example "#ad".

A single plain sentence is enough, for example: "If you sign up through my link, I receive a commission from the Pre-Cana Course at no extra cost to you — in fact you get 10% off."

You are responsible for complying with the advertising and consumer-protection rules that apply where your audience is. Where clergy or parish staff take part, you are also responsible for observing any policy of your own diocese or institution on receiving commissions — we do not assess this for you.

14. Data Protection

You never see who your referred customers are. Your Partner Panel shows counts, totals, and dates — never a name, e-mail address, or any other detail of the people who bought through your link. This is deliberate and is not something we can enable on request.

The personal data we process about you as a Partner — your payout details, tax residence, and commission records — is described in our Privacy Policy. In summary: payout details are stored encrypted, are never sent back to your browser in full, and are deleted when you delete your account — except for records of payments already made, which we must keep for five years to satisfy Polish accounting and tax law.

The referral cookie is described in our Cookie Policy. It is classified as a marketing cookie and is only set with the visitor's consent (§5).

If you collect e-mail addresses or other personal data from your own audience in order to promote the course, you are the controller of that data and are responsible for having a lawful basis to contact them. We are not a joint controller of your list.

15. Nature of the Relationship

Participating in the program does not make you our employee, agent, partner in the legal sense, joint venturer, or franchisee. You have no authority to make representations, enter into commitments, accept payments, offer refunds, or give support on our behalf.

We give no guarantee of any level of traffic, sales, or earnings. The program is a way of rewarding recommendations, not an offer of employment or a promise of income.

To the extent permitted by applicable law, our total liability to you in connection with the program is limited to the Commissions properly earned and unpaid at the time the liability arises. Nothing in these Program Terms excludes liability for death, personal injury, fraud, or anything else that cannot lawfully be excluded.

16. Suspension, Termination, and Changes

You may leave at any time, by telling us at [email protected]. Your discount code is deactivated, and Commissions already approved are paid in the normal cycle.

We may suspend or end your participation at any time on notice. Where we end it without cause, approved and pending Commissions are honoured. Where we end it because of a breach of §12, or because of fraud, we may withhold Commissions connected to the breach; we will tell you which entries are affected and why, and you may respond before the decision is final.

We may also close, pause, or restructure the program as a whole. If we do, we will give participants at least 30 days' notice by e-mail and will honour Commissions earned before it takes effect.

We may amend these Program Terms. Material changes are announced by e-mail at least 30 days in advance and the version number at the top of this page is updated. Continuing to use your Referral Link after a change takes effect means you accept the amended version. Changes never apply retroactively to Commissions already recorded.

17. Governing Law, Language, and Complaints

These Program Terms are governed by Polish law. Nothing in them deprives you of the protection of any mandatory provision of the law of your country of habitual residence that cannot be derogated from by agreement.

The English version of these Program Terms is the binding version. Any translation we publish is provided for convenience only; in the event of a discrepancy, the English text governs.

If something goes wrong, please write to us first at [email protected]. We confirm receipt within 2 business days and answer substantively within 14 days. Disputes we cannot resolve are subject to the courts having jurisdiction under applicable law.
